These Terms of Service ("Terms") govern your use of SkyDog AI (the "Service"), operated by HigherEyez LLC ("SkyDog AI," "we," "us"). By creating an account, subscribing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
SkyDog AI is an AI-assisted content-planning tool for short-form marketing video. The Service helps you research angles, write scripts, and generate shot lists, edit plans, overlays, and step-by-step production checklists. You film, edit, and publish the actual videos yourself using the plans the Service provides. SkyDog AI does not automatically produce, render, or post finished videos on your behalf, and does not guarantee any particular views, sales, income, or business results.
You must be at least 18 years old and able to form a binding contract to use the Service.
You are responsible for your account credentials and all activity under your account. Keep your login secure and notify us promptly of any unauthorized use.
Paid plans (including the "Founder Pilot" plan at $39/month) are billed on a recurring basis through our payment processor, Stripe, until cancelled. By subscribing, you authorize recurring charges to your payment method. You may cancel at any time; cancellation stops future renewals and takes effect at the end of your current billing period. Prices and features may change with notice for future billing periods. "Locked-for-life" founder pricing applies only for as long as your subscription remains continuously active. Except where required by law, payments are non-refundable, though we may issue refunds at our discretion.
You agree not to use the Service to create or distribute unlawful, infringing, deceptive, harassing, or harmful content; to violate the rules of any platform you publish to; to reverse-engineer or resell the Service; or to misuse our systems. You are solely responsible for complying with all applicable laws and platform policies, including advertising-disclosure rules (for example, FTC #ad disclosures for sponsored or affiliate content).
You retain ownership of the photos, footage, and other materials you upload ("Your Content"). You grant SkyDog AI a limited license to store and process Your Content solely to provide the Service. You represent that you have the rights to any content you upload and that it does not infringe others' rights.
The Service, including its software, design, and underlying systems, is owned by HigherEyez LLC and protected by law. These Terms do not grant you any ownership of the Service itself.
The Service uses artificial intelligence to generate plans and suggestions. AI output can be inaccurate, incomplete, or unsuitable. You are responsible for reviewing and approving all output before you act on it or publish anything based on it.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will produce any specific outcome.
To the fullest extent permitted by law, HigherEyez LLC will not be liable for any indirect, incidental, or consequential damages, or for lost profits or revenue. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three (3) months before the claim.
You may stop using the Service and cancel at any time. We may suspend or terminate access if you violate these Terms or misuse the Service.
These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-laws rules.
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date, and your continued use of the Service means you accept the revised Terms.
